Terms and Conditions for Professionals

Your usage of this website is subject to the following terms and conditions. By creating an account on this site you agree to the following:

  1. Relationship. This agreement is made between you and Innovative Legal, Inc. (hereinafter “ILI”) dba KeepOutOfCourt.com. ILI is wholly owned and operated by Forrest Collins, attorney and mediator in Portland, Oregon.

  2. Free basic account. All members may create a free basic account.

  3. Premium account. The first 500 members to sign up for a premium account will receive a free 90-day trial of the premium listing. In order to receive a free trial you must place a valid debit or credit card on file. You can cancel any time during your free trial and your card will not be charged. Your card will be charged $9.00 per month following the expiration of the free trial period. Your card will be charged on the same day of the month as the initial charge for as long as you maintain your account.

  4. Referral credits. You will be credited one month of free service for each professional who you refer to this website who indicates that you referred them when they sign up. This offer is limited to three free months per twelve-month period. The twelve-month period begins after the expiration of your free trial period which means that you could have up to three free months immediately following your trial period.

  5. No guarantee. ILI cannot guarantee any particular volume of traffic to this website or to your particular listing.

  6. Privacy policy. Your information will not be sold, traded or given to any other person or entity.

  7. Advertising and your state bar or regulatory body. You are required to abide by the terms of your state bar or any other licensing or regulatory body to which you may be subject. ILI is not responsible for whether the content of this website (including advertisements, blog postings, professional listings, or any other content) complies with the requirements of any applicable agency or body.

  8. Intellectual property. The following provisions apply regarding intellectual property:

    1. You may submit blog postings which will be published at the discretion of ILI. Just because a blog is submitted does not mean that it will be accepted for publishing.

    2. ILI may make non-substantive changes to your post (correcting misspellings, punctuation, etc.) but will not make substantive changes to your post without your permission.

    3. You own any blog article that you post and may reproduce it or modify it on this website or other websites or other mediums as you see fit.

    4. You shall not copy any content from KeepOutOfCourt.com to your own website. You may link from your website to any content on KeepOutOfCourt.com.

    5. You may copy content from KeepOutOfCourt.com for handouts, fliers or related materials which may be distributed in your office. Content from KeepOutOfCourt.com shall not be reproduced in any electronic medium or format without the express, written consent of ILI.

    6. Authors of the blog posts continue to own their blog postings. Therefore, any copying or recreating of blog posts must be done only after receiving the author’s written permission.

  9. No right to account. Your account may be terminated by ILI in its sole discretion and for any reason. You have no ongoing right or vested interest of any kind to continue to be listed on this site. Your participation on this site occurs solely at the pleasure and discretion of ILI. Termination by ILI will result in a refund for the month in which your account is terminated.

  10. Limitation of liability. ILI’s liability shall be limited to the total monthly fee(s) paid by the account holder during the period for which liability is claimed or alleged.

  11. Closing account. You can close your account at any time and there is no termination fee. No refunds will be issued for the month in which you close your account.

  12. Choice of law. The terms of this agreement will be governed by the laws of the State of Oregon.

  13. Mandatory mediation and arbitration. Any dispute regarding the terms or enforcement of this agreement will be subject to mandatory mediation followed by mandatory arbitration in Multnomah County, Oregon.

  14. Modification of terms. ILI may revise these terms periodically at any time and without notice, except that the monthly fee will not be changed without a minimum of thirty days notice. By using this website you are agreeing to be bound by the then-current version of the Terms and Conditions.

  15. Force majeure. ILI’s performance under these Terms and Conditions are subject to interruption and delay due to causes beyond its reasonable control, such as acts of god, acts of any government, war or other hostility, the elements, fire, explosion, power failure, civil disorder, equipment failure, labor or industrial dispute and the like.
